This entry is part 45 of 99 in the series Deeds in the Family

I am posting information gleaned from land records in the areas where our family’s ancestors resided. You can read more about this project in the overview. You may also check my deed record listing, which I will update frequently, but probably not every day. This group pertain to Papa’s Fenton ancestors who resided in Wexford County, Michigan.

Witnesses: Horace H. Hogue, Vera B. Hogue
Type of deed: Warranty
Rec’d and recording: 30 April 1915
Clerk/registrar: Slack
Location of land: Colfax
Consideration: $1 and other valuable consideration
Notes: Harmon granting his wife 1/2 interest in his property.
Description: S 1/2 of the SW 1/4 of NW 1/4 AND N 12/ of NW 1/4 of SW 1/4 both Sect 16; AND SE 1/4 of SW 1/4 Sec 9 All in T23N R10W

According to the dower laws of Michigan, Harmon’s wife Susie was entitled to one-third of his property after his death. Harmon Longstreet must have wanted Susie to have half of the property, so he granted it to her legally.

This drawing constructed from the 1908 Atlas1 of Wexford County shows the holdings of Harmon Longstreet in Wexford County. The Atlas names the owner as “Herman” instead of “Harmon”.

Consideration: $300
Notes: Deed Restriction: Second Parties agree that said premises will not be used before April 14, 1929 for the business of General photography or maintaining a photograph gallery.
Description: Description: Lot 26, Manton

This transaction reverses the “sale” of Lot 26 in Manton which occurred on the deed recorded in Liber 97 page 369. Yesterday’s post was about that deed.

I guess that Frank and Sarah Howe needed a loan in January 1921. It cost $50 for them to borrow $250 for just a period of about 22 months! This type of loan was far more common that I could have imagined. I had not realized what was happening until I began to write about transactions, and compare land descriptions.

There was less buying and selling, and more loaning with property given as security.

Description: Lot 26, Manton

Susie Burdick Fenton Longstreet’s niece, Etoile, was married to Charles B. “Bert” Howe. It is possible that the Frank Howe who sold this lot to Harmon and Susie was somehow related to that family, but I have no evidence that he was.

This lot is from the original town plat of Manton, I have illustrated the location on a section of the old 1889 atlas 1. You can click the thumbnail to view an enlarged version.

97-369

It is possible to take a look at the current configuration of this area in Google maps. Depot Street has been re-named State Street since this atlas was printed, and what was known as Seaman Ave is now Michigan Avenue (old US 131). Keep in mind that lot 26 is the third lot north of the corner of Rose and State Street.

Description: E 1/2 of the SW 1/4 Sect 5 T23N R10W

Alfred Thurston Fenton married Hazel Janette Tossey on 20 February 1917. An old family history states that the first two children of this couple were born in Lansing, Ingham, Michigan. This seems likely, since the family was enumerated in Lansing on the 1920 census1, where Alfred was listed as a “Varnish Rubber, Auto Co. I guess Detroit and Lansing were just one big far away place to some residents of Wexford County, even in 1918.

This purchase was in Alfred’s home neighborhood. You can enlarge the thumbnail, made from the 1914 Atlas2 of Wexford County, to see the purchased land and some of the neighbors land better.

The red outline represents the purchase on this deed. The blue X at the township line marks the land originally purchased by George Burdick in the township; George was Alfred Fenton’s maternal grandfather. The blue squares mark property along 29 1/4 road which was owned by Harmon H. and Susie Longstreet. Susie was Alfred’s mother.

Edited on 26 January 2010 to correct the outline of the land described in the deed.

Type of deed: Warranty

Description: S 1/2 of NE 1/4 Section 12 T23N R9W

Wow, I have see a few transactions, I for this description, and some for parts of it. I will refer to they by the form: Liber-Page, link to my previous post on each, and give a summary.

11-327 – John P and George Fenton purchase some rights to the S 1/2 of the NE 1/4 from Willis Gladding. Executed 17 July 1875, recorded 31 May 1881.

3-219 – Eliza John Fenton perfects the homestead claim made by her late husband, John to the S 1/2 of the NE 1/4.

6-404 – Land grant deed recorded in Wexford County, Michigan records, the S 1/2 of the NE 1/4. Recorded 3 March 1876

48-160 – This record, George Fenton sells some rights to the S 1/2 of the NE 1/4 to John Fenton. Executed 24 May 1876. Recorded 4 Feb 1931

7-25 – John P. and Susie Fenton sell the SE 1/4 of the NE 1/4 to Samuel Carpenter. Executed 9 July 1877. Recorded 11 July 1877

7-26 – John P. and Susie Fenton sell the SW 1/4 of the NE 1/4 to Samuel Carpenter. Executed 1 July 1877. Recorded 11 July 1877

8-561 – Eliza John Fenton Thurston sells some rights to the the S 1/2 of the NE 1/4 to John P. Fenton. Executed 2 July 1878. Recorded 24 July 1878

8-562 – John P. and Susie Fenton sell the S 1/2 of the NE 1/4 to Coulter & Walter of St. Johns Michigan. Executed 15 May 1878. Recorded 29 May 1880.

If this does not give you a headache, nothing will. I suspect there may be some answers in the mortgage books, which I have not looked at. Perhaps Willis Gladding had loaned John or Eliza money, or Willis Galdding had also made a claim to the land. When George Fenton signed off of the property, John P. must have held the deed and not recorded it.

John P. Fenton died 23 March 1891 in Hamlin, Audubon, Iowa. George Fenton died 29 April 1916 in Grand Traverse County, Michigan. Their remaining sibling, Salina “Lina” Fenton Watson died 7 June 1939 in Cadillac, Wexford County, Michigan.

I checked through the records I have for many descendents, and the only date I could find close to 4 February 1931 was the 1 April 1931 marriage of Mary Eliza Fenton Jenkins to Harry J. Houghtalin. Mary Eliza was a daughter of John P. and Susie Fenton. Perhaps during her divorce, subsequent re-marriage, or while cleaning and moving that may have accompanied her re-marriage, Mary found the unrecorded deed and took it to the courthouse. I do know that Mary’s descendents are in possession of an archive of letters written by Susie M. Burdick Fenton to her Michigan family, as transcriptions were provided with a family history. Mary may have held other historic papers, also.

I also find that Susie Burdick Fenton Longstreet died on 20 December 1931. Her second husband, Harmon H. Longstreet died 28 June 1931. It may be that the deed was among deeds and possessions of the Longstreets, and was found when Harmon became ill and close to death. It is common for people to organize their affairs when they become elderly and or sick.

In any event, the deed which cleared George Fenton’s claim to the property was recorded many years years after John sold the property to Coulter & Walter.

Hope you are both well

and enjoying the winter

Harry L. Burdick was the son of Fink Burdick, Susie M. Burdick’s brother.  Two of Susie’s children married Belle’s children; Susie’s son Ross P. Fenton married Edna Fellows, and Susie’s daughter Lila M. Longstreet married Frank A. Fellows. Harry and Vernice didn’t have any direct relationship to Belle, but the families were inter-married, lived in the same area, and were well known to each other.

you like your new

place in view want to
hear from you soon
your fir end Mrs Stone

On the 1910 census of Michigan, Wexford County, Colfax Township, district 146, sheet 4, dwelling 99, family 101 is the Stone family. Lester E. 33, Sarah E, 29 and Sarah’s father, Samuel R. Simmons age 66. The Stone family was enumerated on the same page as the Longstreet’s (two of Belle’s children married children of Susie Burdick Fenton Longstreet), the Schutte family and Alfred Fenton, another of Susie Longstreet’s children.

A check of the 1920 census confirms that it was probably Sarah Stone who wrote the letter. The family is residing in District 215, Harrison, Montgomery, Ohio and is enumerated on sheet 4A, dwelling 81, family 81. Samuel R. Simmons is still living with his daughter and son-in-law, and the family has no children. Harrison is near Dayton, today it would be considered a suburb.
